Message: Dear Governor's and Legislator's, Attached with this e-mail is the "RESPONSE TO MOTION TO DISMISS" which was filed in District Court yesterday, June 7, 2000. The original petition for judicial review was filed on March 1, 2000, but I failed to serve the U. S. Attorney's office in Eugene until May 15, 2000. This was my error as I did not understand all of the responsibilities for my actions. On May 18th, 2000, the U. S. Attorney filed a "MEMORADUM OF LAW" and a " MOTION TO DISMISS". I have not scanned these two documents to be able to attached them with e-mails. If anyone in the group would like to get a copy of these documents, please send your fax number and name to this address and I'll be more than happy to fax the info. More likely than not, (like 100% not) the Court will probably dismiss this request for judicial review. You are all politicians and a majority of you are attorneys and will probably side with the Court on this issue. And, I also hope you understand why this request was sent to the CourtG..One of the contacts I made researching this proposed amendment is a con law professor; he just had a fit to think that I had even considered requesting judicial review because it violated the separation of powers in the federal government. (I got the impression that he wasn't going to be much help in the future!!!) When the Court rules on these motions or when any other information comes to my attention, I will relay the information to you. Gore says leave it alone and Bush says let people invest 1 or 2 percent of their money. Both men know that it will take the "Second Coming" for the Congress to act in a positive manner on this issue. Both men are right for the wrong reasons, and both men are wrong for the right reasons. Sections 9 and 14 of the proposed amendment deal with the Social Security question. This is a very complex issue while the answer is very simple. If you haven't taken the time to run this past your financial advisor, PLEASE take the time now to do so. If any of the advisors tell you this plan will not work, let me know and we can have a meeting of the minds.
