The State of Mississippi is in a crisis. To date, the majority of debate and media coverage has centered around the medical community and the necessary reform relating to it. While there is no doubt that something must be done to address the medical crisis, there is much more that needs to be done. This is not just a medical malpractice issue. We need comprehensive civil justice reform immediately. The crisis involves more than one group. We cannot settle for a minor cure for such a grave problem. Mississippi must protect every entity from this epidemic. We all lose when doctors flee our state and businesses reduce jobs and investments or decide not to locate in Mississippi. We also pay more for health care and our standard of living declines. More of us go without health insurance and more paychecks are put at risk. It is not enough to focus on partial legislative fixes. Our elected officials need to be proactive. Real relief and progress will only come about when the business community and the medical community are addressed at the same time with the same level of seriousness. Mississippi needs fairness and balance in its civil justice system. The Mississippi Restaurant Association supports legislation that will improve the legal environment in Mississippi. The Mississippi Restaurant Association supports tort reform especially in the areas of litigation venue, capped punitive damages and the elimination of punitive damages on criminal acts by third parties. Restaurant owners are experiencing the by-product of a litigious environment by increased insurance costs both in the health care and property/liability insurance. The Mississippi Restaurant Associations believes that the legal environment should be fair for all and not burdensome to the business community. Again, The Mississippi Restaurant Association implores you to address comprehensive civil justice reform for the upcoming special session you intend to call. Please work with us to achieve comprehensive civil justice reform. Anything less is not enough.
